5. How the calculation works

overtime pay = overtime hours × (1.5 × regular rate) — only for hours over 40/week
hourly rate from salary = annual salary ÷ 2,080 or weekly salary ÷ 40
  1. New York follows the federal FLSA standard. NYDOL wage orders require 1.5× the regular rate for hours over 40 per week; there is no general daily overtime rule in New York. Live-in employees use a 44-hour/week threshold.
  2. Minimum wages used in mode 4 (last verified October 9, 2026): New York City $17.00/hr; Long Island & Westchester $17.00/hr; rest of NY state $16.00/hr — all since January 1, 2026 (previously $16.50/$16.50/$15.50 in 2025). Starting 2027 rates are indexed to inflation (Northeast CPI-W).
  3. New York exempt thresholds are higher than federal (last verified October 9, 2026): $1,275/week ($66,300/year) in NYC, Long Island, and Westchester; $1,199.10/week ($62,353.20/year) in the rest of the state — since January 1, 2026. The federal $684/week ($35,568/year) threshold is the 2019 rule restored after the 2024 DOL rule was vacated by a federal court on November 15, 2024.

Worked examples

NYC minimum-wage worker: $17/hr, 45 hours (40 regular + 5 overtime)

Overtime rate $25.50/hr. Overtime pay: 5 × $25.50 = $127.50. Base pay: 40 × $17 = $680. Weekly total: $807.50.

Salaried worker: $52,000/year, 45 hours

Regular rate $25.00/hr. Weekly pay $1,000 + overtime 5 × $37.50 = $187.50. Total: $1,187.50.

Rest-of-state worker: $16/hr, 45 hours

Base pay 40 × $16 = $640. Overtime 5 × $24 = $120. Total: $760.

$18/hr worker, 50 hours (40 regular + 10 overtime)

Base pay 40 × $18 = $720. Overtime 10 × $27 = $270. Total: $990.

What this calculator does not compute

  • Overtime tax. This tool computes gross overtime pay. The federal income deduction on qualifying overtime pay (tax years 2025–2028) is a separate matter — see the overtime tax calculator.
  • Full net pay. For federal/state withholdings and take-home pay, use the take-home pay calculator.
  • Generic salary conversion. For salary ↔ hourly conversion outside the overtime context, see the salary hourly calculator.
  • Other states. The Georgia version (FLSA, federal minimum wage $7.25) is at georgia overtime; the Florida version (FLSA + Florida minimum wage $15.00) at florida overtime; the Illinois version (FLSA + Illinois minimum wage $15.00 / Chicago $16.60) at illinois overtime; California is totally different because of daily overtime — see california overtime.
