Trademark Cost Lab

How much does a trademark really cost? Not just the filing fee — the classes, the surcharges, the Statement of Use, the 5-year declaration, the 10-year renewal, the attorney question, and the international path. This lab computes the full 10-year picture from the current USPTO fee schedule, entirely in your browser.

⚠ Educational estimates — not legal advice. Every figure here is computed from the published USPTO fee schedule (effective January 18, 2025) or clearly marked as an estimate. It is not legal advice and using this tool creates no attorney-client relationship. Fees change; verify at uspto.gov and consult a licensed trademark attorney before filing.

45-Class Finder

Trademarks are filed per Nice class — 45 of them (1–34 for goods, 35–45 for services), and you pay for each one. Describe what you sell and the lab will match it against curated keywords for every class.

10-Year Total Cost of Ownership

The filing fee is just the cover page. A US trademark also requires a Section 8 declaration in years 5–6 ($325/class) and a Section 9 renewal every 10 years ($325/class). This is the honest decade.

Multi-Country Estimator

US fees are verified from the USPTO 2025 schedule. All other jurisdictions are estimates — national offices change fees; confirm every figure before budgeting.

Attorney vs DIY Comparator

Government fees are identical whoever files. The difference is service cost vs risk: a weak clearance search or a bad office-action response costs far more than the filing fee.

Trademark vs LLC — cost & order

The most expensive misunderstanding in small business: an LLC name is not a trademark. Registering “Sunrise Bakery LLC” with your state stops nobody in the next state from using “Sunrise Bakery”.

™ Trademark — from $350/class

$350/class USPTO

Protects your brand: name, logo, slogan — nationwide, against competitors. Rights go to whoever uses it in commerce first.

🏢 LLC — $50–$500+/state

varies by state

Protects your personal assets: separates you from business debts and lawsuits. Says nothing about brand rights.

Compare full LLC costs by state

LLC filing fees, annual reports, and franchise taxes vary wildly by state — our companion LLC Cost Lab covers all 50 states + DC with 1/5/10-year TCO, so you can budget both filings together.

Renewal Deadline Planner

US trademarks die from missed maintenance, not from age. Enter your registration date and the lab will compute your Section 8 and Section 9 windows — including the 6-month grace periods.

Methodology & data sources

  • US fees (verified): USPTO “Summary of 2025 trademark fee changes” (uspto.gov), effective January 18, 2025 — base application $350/class; insufficient-information surcharge $100/class; free-form ID surcharge $200/class; each extra 1,000 characters $200/class; Statement of Use $150/class; Madrid §66(a) $600/class; Section 8 $325/class; Section 9 $325/class; Section 15 $250/class. TEAS Plus/Standard retired on that date.
  • Nice classes: all 45 class titles follow the WIPO Nice Classification (classes 1–34 goods, 35–45 services); keyword mappings are curated by nrtechstudio for matching and are indicative, not authoritative.
  • Country fees (estimates): EUIPO, UKIPO, CIPO, IP Australia, and India figures are estimates compiled October 2026 and flagged as such in the tool — national offices change fees; verify with the office before budgeting or filing.
  • Attorney/service ranges: market ranges for US trademark practice (flat-fee filings, 2024–2026), educational only; actual quotes vary by market and complexity.
  • What is NOT included: office-action response costs beyond filing fees, opposition/cancellation proceedings, state trademark registrations, or foreign associate counsel fees for direct national filings.
